What Qualifies as Age Discrimination?
If you were treated less favorably than someone else because of your age — whether in hiring, firing, layoffs, training, pay and benefits, or another employment practice — you may have a claim for age discrimination. The following are examples of successful age discrimination cases:
- An employer's decision to hire only people under 40 years old or fire/layoff anyone over 40 (wrongful termination)
- Failure to promote because of age
- Harassment, including offensive comments about age, that leads to a hostile work environment
- Employment policies that have a disparate impact on anyone over 40 years old
Who Can Bring a Claim for Age Discrimination?
Under the federal Age Discrimination in Employment Act (ADEA), anyone age 40 or older can bring a claim of age discrimination. Colorado has a similar law except that anyone over 70 cannot bring a claim under state law.
The state and federal employment laws also differ in one other respect: under federal law, your company must employ a certain number of employees before you can bring a lawsuit against it. Colorado does not have the same limit. Therefore, it is often possible to bring a state claim against a smaller employer than would be allowed through the U.S. Equal Employment Opportunity Commission (EEOC).
